Accounts and Passwords This agreement applies to all community member accounts, administrator-forum-accounts, and alternative account names associated with your principal account. You are responsible for the use of each of your accounts, whether used under any name or by any person, and for ensuring full compliance with this agreement by all users of that account. You are responsible for maintaining the confidentiality of your passwords. In the event of a breach of security through your account, you will be liable for any unauthorized use of the Sayalagi service until you notify Sayalagi support. Sayalagi service strictly prohibits Posting (making accessible from the outside) of any content associated with (but not limited to) underage nudity (or sexual overtones) as well as links to such resources. Sayalagi may immediately restrict, suspend or terminate without notice, your access to and use of Sayalagi upon any breach of this agreement, including the then-current Acceptable Use Policy. Sayalagi may also terminate the agreement at any time for any reason for no reason. Upon and after termination, Sayalagi will not be obligated to provide you with access to any SLforum related to your account. Your only right with respect to any dissatisfaction with any terms, rules, policies, guidelines, or practices of Sayalagi in operating Sayalagi, any change in the content of Sayalagi, or any change in the amount or type of fees charged in connection with Sayalagi, is to terminate this agreement by delivering notice to Sayalagi, effective the day Sayalagi receives notification of termination. Subdomains and Custom Domain If Sayalagi and our domain partners assigns you a subdomain address for your use of Sayalagi, the right to use that subdomain address will belong only to Sayalagi/partners, and you will have no right to use that subdomain address except as allowed by Sayalagi in its sole discretion. Sayalagi allows you to use a custom domain as your SL Forum address without having to pay a monthly fee. Please Read Our Agreement Amendment Sayalagi may modify this agreement or the Acceptable Use Policy at any time in its sole discretion. Any modification is effective immediately upon either a posting on the Sayalagi website at http://sayalagi.com or by a message from SL Community sent by electronic mail, or by conventional mail. If you do not terminate your registration, or continue to use the Sayalagi Service, following notice of any modification to this agreement, your continued use will mean that you have accepted that modification. Disclaimer Sayalagi service is provided on an As Is, As available basis without warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose or non-infringement. Sayalagi expressly disclaims any representation or warranty that the Sayalagi service will be error-free, secure, or uninterrupted. No oral advice or written information given by Sayalagi, its employees, licensors, or the like, will create a warranty; nor may you rely on any such information or advice. The terms of this section will survive any termination of this agreement. All sayalagi.com system services are provided in the form they were developed in. User cannot require sayalagi.com to upgrade or change service delivery in accordance with his/her personal needs. Commerce on the Community Through your uses of the Sayalagi service, you may have opportunities to order and purchase custom style or services from members of community. You further acknowledge that all transactions relating to custom style or services offered by you through the Sayalagi service, including but not limited to the purchase terms, payment terms, warrantees, guarantees, maintenance and delivery terms for such transactions are agreed to solely between you and the person who sells. Sayalagi and its affiliates partner hosted make no warranties or representations whatsoever with respect to your goods and services or with respect to the qualifications of any third party purchaser. LAWFUL PURPOSES You may use the Site and Service for lawful purposes only. You agree to be financially responsible for all purchases made by you or someone acting on your behalf through the Site. You agree to use the Site and to purchase services or products through the Site for legitimate, non-commercial purposes only. RECOVERY OF LITIGATION EXPENSES If any legal action or any arbitration or other proceeding is brought for the enforcement of this Agreement, or because of an alleged dispute, breach, default, or misrepresentation in connection with any of the provisions of this Agreement, the successful or prevailing party or parties shall be entitled to recover reasonable attorney’s fees and other costs incurred in that action or proceeding, in addition to any other relief to which it or they may be entitled. SEVERABILITY If any term, provision, covenant, or condition of this Agreement is held by an arbitrator or court of competent jurisdiction to be invalid, void, or unenforceable, the rest of the Agreement shall remain in full force and effect and shall in no way be affected, impaired, or invalidated. ASSIGNMENT These Terms and Conditions bind and inure to the benefit of the parties’, successors and assigns. These Terms and Conditions are not assignable, delegable, sublicenseable, or otherwise transferable by you. Any transfer, assignment, delegation, or sublicense by you is invalid.
